Subscription & Fees

• Subscription Fee: You acknowledge and agree to pay a monthly subscription fee of $35 for Culinary Hosting services.
• Payment Method: You will be prompted to provide a valid payment method during signup. Your subscription will automatically renew each month unless canceled before the renewal date.

Website Development Process

• Business Information: You must provide your business’s legal name, address, business hours, and phone number. This information will be exclusively used for and displayed on your restaurant’s website.
• URL Selection: Upon subscribing, you will receive an email asking you to choose your preferred website URL from our suggestions or provide a custom URL. We will confirm the availability of your chosen URL.
• Your Restaurant Story’s: You will need to provide a brief history of your restaurant and its significance. You can choose to have your story added directly to your website or enhanced by our content team.
• Menu Submission: You must send us a picture, Word document, or PDF of your menu. You can update your menu at any time by emailing us at info@culinaryhosting.com.
• Food Photos: You can provide photos of your entrees or use stock photos. Alternatively, we can arrange a photographer to take professional photos at your restaurant (for an additional fee). These photos will be used throughout your website.

Website Ownership & Transfer

• Ownership: The content and design of your completed website will remain your property. You have the full right to transfer your website to another hosting provider at any time.
• Transfer Fee: A one-time transfer fee of $75 will be applied if you choose to move your website to a different provider within the first 3 months of your subscription. This fee covers the administrative costs associated with website transfer assistance.

Term & Termination

• Subscription Term: This subscription agreement is for an indefinite term, meaning it will continue month-to-month until terminated by either party.
• Termination by You: You may cancel your subscription at any time by logging into your account dashboard and selecting the “Cancel Subscription” option. Cancellation will be effective at the end of your current billing period.
• Termination by Culinary Hosting: Culinary Hosting reserves the right to terminate your subscription for violation of these terms and conditions or for any other reason deemed necessary. In such cases, a prorated refund may be issued for any unused portion of the prepaid subscription fee.

Acceptable Use Policy

You agree to use our services in a manner that is consistent with all applicable laws and regulations. Prohibited content and activities will be removed, these include but are not limited to:

• Illegal content, such as material depicting child exploitation or promoting violence.
• Hate speech or content that is discriminatory or offensive.
• Spam or unsolicited commercial emails.
• Malicious content, such as viruses, worms, or other code designed to harm our systems or the websites of others.
• Infringement of intellectual property rights, such as copyrights or trademarks.

Data Backups

Culinary Hosting takes data security seriously and implements industry-standard security measures to protect your website content. We perform regular backups of your website data and will restore it in the event of data loss caused by our negligence.

Updates & Modifications

Culinary Hosting reserves the right to update or modify these terms and conditions at any time. We will post any changes on our website and notify you via email. Your continued use of our services following the posting of changes constitutes your acceptance of the revised terms.

Governing Law & Disputes

• Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of laws principles.
• Dispute Resolution: Any dispute arising out of or relating to this Agreement shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration may take place at a flexible location, including online, as per the terms and conditions.
